Early in June of 2014, Melanie Griffith filed for divorce from her husband of 18 years, Antonio Banderas.  The divorce was filed for irreconcilable differences.

While the divorce so far appears to be amicable, the two questions on everyone’s minds are how will their assets be split and who will gain custody of their child?

Assets Worth Millions

Together the couple owns assets worth 50 million dollars.  They own property in Spain, California, New York and Colorado (in Aspen specifically).

While he is an actor, Banderas is also a “shrewd businessman” and has invested his money in multiple properties.

The couple owns commercial real estate and restaurants in Miami, Los Angeles and around the world as well.  They have not spent money beyond their means and have been able to afford all their investments.

In Arizona, any property that is acquired by either spouse during the marriage will be split 50-50 during a divorce.   When married, a couple shares ownership in community property and courts will try to divide property equally.

During a divorce in Arizona, couples may split the proceeds earned from selling property.  However, ownership rights of real estate assets is very difficult to determine and courts may need to decide.

It will be interesting to see if their divorce follows a similar plan.

Custody of Child

Griffith and Banderas have a 17-year-old girl, Stella.  Griffith filed for child support and sole physical and joint custody of Stella.

In Arizona, the courts must decide about the custody and child support of children under the age of 18.

The most popular form of child custody is joint custody where parents make joint decisions about the child’s life.

Sometimes physical custody or the “parenting time” where the parents are spending time with the child is split 50-50 as well.  However, the courts will determine if this is reasonable for the child per case.
