What Constitutes a Construction Defect?

In the broadest sense, nearly any condition that reduces your home’s value can be classified as a construction defect.  Construction defects fall into two categories:  Defects in design, workmanship and materials, and Landslide and earth settlement problems.  Compensation can be awarded to homeowners or homeowner associations for damages arising from defects of either type.

  • Defects in design, workmanship and materials may include, but are not limited to :
    • Lighting defects
    • Plumbing defects
    • Electrical problems
    • Security defects
    • Poor insulation
    • Poor sound protection
    • Landscape or irrigation problems
    • Structural problems
    • Dry rot
    • Drainage problems
    • Water seepage
  • Landslide and earth settlement problems may include, but are not limited to:
    • Drainage problems
    • Problems arising from underground water
    • Soil expansion
    • Structural settlement or movement
    • Land slide issues
    • Problems arising from poor grading
