In order for someone to be officially charged with a DUI in Phoenix AZ, the case must involve the following three elements at minimum:
- The individual was driving, operating or sometimes even just sitting in a driver’s seat or behind a wheel.
- The individual was in control of a motor vehicle, such as but not limited to a: car, motorcycle, bike or boat.
- The individual’s blood alcohol level was above the legal limit of 0.08 (0.01 for those under the age of 21), or the individual was under the influence of an intoxicating beverage and/or drug.
While these three elements are generally part of all DUI cases in Arizona, there are also some elements that can vary from case to case. Therefore, I always encourage anyone facing DUI charges in Phoenix AZ to consult with an attorney who can assess their individual case. Since DUI charges Phoenix AZ can be extremely serious, an attorney can also provide individuals with information about the possible consequences of their specific DUI charge.
