Possession of Marijuana in Arizona

Typically, possession of marijuana in Arizona is charged as a class 6 felony.

It is not unusual; however, to be offered a plea to a class one misdemeanor.  In Arizona, depending on the jurisdiction, you may be offered the opportunity to participate in a diversion program wherein if you test clean for a period of time and participate in drug counseling, the charges against you will be dismissed.

If the amount of marijuana seized was not a usable amount, it may serve to defeat the possession charge.  However, possession of marijuana is often charged with possession of drug paraphernalia which does not have a usable amount requirement.
