First DUI in Tempe – Are breathalyzers reliable?

If you were pulled over for a DUI in Tempe, chances are the officer arrested you and gave you a citation with a court date for one of the Tempe Courts (Tempe Municipal Court, Kyrene Justice Court, University Lakes Justice Court).  If you opted to blow into the portable breath test, that information might have been used to obtain probable cause that you were driving under the influence.

Because the portable breath test is not always reliable, your actual BAC, whether taken by blood draw, or intoxilyzer, may be different.  The penalties you would face for a first time DUI would depend on a number of factors including your BAC test results, your legal defenses, and your attorney’s ability to negotiation and leverage the strengths of your case.
