If you have been charged with a DUI in Arizona your license may already be suspended. For a first time DUI, your license will be suspended for 90 days if you are convicted or prior to that because of the Admin Per Se. You have a right to challenge the Admin Per Se suspension by requesting a hearing and presenting evidence on your behalf. The MVD hearings are separate administrative hearings and may be taking place at the same time as the criminal DUI case. To be safe, you should verify the status of your license with the MVD prior to driving a vehicle so that you won’t be charged with driving on a suspended license – a misdemeanor offense.
