Charged with DUI, but I wasn’t driving!

In order to be found guilty of a DUI in Arizona the state must prove beyond a reasonable doubt that you were in actual physical control of the vehicle.  This can be shown in a number of different ways including eye witnesses seeing you drive.  Sometimes the actual physical control element is demonstrated by having access to the keys or the keys in the ignition.  If you were seated behind the wheel with the keys in the ignition and the car was on, that is pretty good evidence that your were in actual physical control of the vehicle.  DUIs in Arizona are complex cases with severe financial penalties and mandatory jail sentences.  Consulting with a DUI attorney can make a big difference in your case.
