Do I have to wait to have my crime set aside or expunged?

In Arizona, true expungement, with some statutory restrictions,  is available for most crimes committed while the person is under 18 years of age.  If the crime was committed as an adult, then the person would need to successfully complete probation and file a motion to set aside the judgment.  There is no mandatory time to wait prior to asking the court to set aside a crime.  Each case will be looked at based upon individual facts and circumstances. 

Typically, once all obligations to the state are resolved, the person needs to wait a period of 3-6 months to demonstrate to the court that they are able to obey the law after probation.  In some exceptional case, the court will set aside the crime immediately after the person finishes probation.
