Can My Felony Become a Misdemeanor?

If a person enters a guilty plea to a class 6 undesignated offense, then there is an opportunity to have the court designate the offense a misdemeanor. This misdemeanor designation most often occurs after successful completion of probation. However, there are times when the court will designate the case a misdemeanor at the time of sentencing.

After successful completion of probation on a first time felony offense, the person’s rights should be restored automatically. These rights do not include the right to possess a firearm. That right must be applied for separately. If the case cannot be designated a misdemeanor, and even if it can, the person can motion the court to set aside the guilty plea/verdict thereby removing the conviction from the person’s record.
