The State of Arizona’s case against those charged with a DUI

When forming a case against someone charged with a DUI, the state’s main goal is to gather evidence showing that the person being charged with the DUI was one, driving, or two, in physical control of a motor vehicle while under the influence or impaired.

To establish this, the state will look at the physical symptoms of impairment, driving symptoms of impairment, verbal admissions and physical chemical tests such as a breathalyzer or urine test. Physical symptoms of impairment are things like slurred speech, watery eyes and inability to follow directions. Driving symptoms include erratic, spontaneous braking, straddling the center lane, or following too closely behind another driver. Verbal admissions are statements like, “I shouldn’t have had so much to drink,” or “I only had six drinks all night.”

Arizona’s Implied Consent Law

Arizona’s implied consent law requires that if an arrest is alcohol related, the person arrested is required to take a blood or breath test. That same law says that if the arrest is drug related, the arrested person is required to take a blood or urine test. The State of Arizona will look at all of these things when establishing their case against someone arrested for a DUI.
