<li>Do your homework when picking a daycare.  Find out the licensing agency and research if there have ever been any issues.  Figure out who will be around your child and ask for background checks.  Get references and talk with others regarding their experiences with the daycare.  Visit the facility while children are there to get a feel for how things are run.  Your child’s safety is most important.</li>
<li>Continue doing your homework.  Even if it seems like you have found the perfect daycare, continue to ask questions.  New people can start working or daily routines can change.  Show up when they are not expecting you.  Get to know the other parents and question them if they decide to switch daycares.</li>
<li>Pay close attention to your child.  Ask them about their day and their interactions with friends and teachers.  If something has happened to your child, they might not admit to it.  So pay attention to their mood and how they act.  Just because your child is acting differently, doesn’t automatically mean they are being abused, it is just a good idea to be a little more alert.</li>

Lisa constantly reminded the school bus driver and the school bus aid about her daughter’s special needs. Isabella suffered from neuromuscular disorder, which affects her walking and head control. <a href="http://www.wtsp.com/news/topstories/article/280658/250/Hillsborough-School-District-sued-over-7-year-olds-death?hpt=ju_bn4 " target="_blank">When Isabella gets on the bus, the school staff is supposed to tilt Isabella’s wheelchair in order to stabilize her head.</a> On one particular day the staff aboard the bus forgot to do that.</p>
<p>The school bus video shows Isabella’s head bobbing back and forth many times over a 17 minute period. The bus driver aid notices that Isabella isn’t breathing and yells for the bus driver to pull over and call 911. The bus pulls over in front of a pediatrician’s office, but instead of calling 911, the bus driver calls Isabella’s mom.</p>
<p>The school bus pulled over a 2:24pm; Lisa arrived and was on the bus at 2:32pm. She saw that her daughter was blue and began performing CPR. Lisa was the first and only person to give CPR to Isabella. When Lisa realized that no one had called 911 yet, she called them herself. While Lisa was on the phone with police, the bus driver finally decided to give Isabella CPR, but it was too late, Isabella died the next day.</p>
<p><a href="http://www.jacksonwhitelaw.com/az-personal-injury/types-of-injury/negligent-supervision/">Herrera’s attorney is arguing that the school is negligent</a>, because their staff is not only untrained, they lack common sense. The staff on the school bus watched a child die, didn’t call 911, didn’t perform CPR, and didn’t remove her from the bus even though they were parked in front of a pediatric clinic. The bus drivers and aids are not required to take additional training when dealing with special needs children. The school offers additional training, but it’s optional.</p>

<p>Antonio Reyes drowned in gym class that day. The lawsuit stated that the school didn’t have a lifeguard on duty, they didn’t have a rope separating the deep and from the shallow end, and they didn’t even know if Antonio Reyes could swim. <p><a href="http://www.kshb.com/dpp/news/local_news/investigations/blue-springs-school-districts-insurance-company-settled-bullying-lawsuit-for-500000?hpt=ju_bn5 " target="_blank">In 2007, the parents of 12-year-old Brandon Myers lived their worst nightmare.</a> Brandon hanged himself in their family home after all of the bullying and torment pushed him over the edge. The Myers family filed a lawsuit against the Blue Springs School District for the wrongful death of their son. Brandon’s parents encouraged him to notify a teacher of the bullying, but the teacher’s response indicated that Brandon should stop being a “tattletale.”</p>
<p>During the course of their <a href="http://www.jacksonwhitelaw.com/az-personal-injury/types-of-injury/wrongful-death/">wrongful death claim</a>, the Myers family and their attorney discovered that the school district had hid key pieces of evidence. The school hid Brandon’s journal and two suicide notes. The school’s insurance company settled with the Myers family in the amount of $500,000. The lawsuit also required that two school administrators be retrained in bully awareness. Every school within the district must also hold a bully awareness day.</p>

<p>Parents that drop off their children at day-care facilities put a reasonable amount of trust in those facilities to keep their children safe. <a href="https://www.lafitness.com/pages/kidsklubPage.aspx " target="_blank">LA Fitness’ Kids Klub page</a> states:</p>
<p>“Our Kids Klub offers a great babysitting service on premises so that you may enjoy a worry-free workout. We provide not only a safe environment, but plenty of engaging activities for children ranging from games to study stations, play mazes to reading sessions.”</p>
<p>The parents of the 18-month-old girl only wanted a refund for the gym services they weren’t going to use, but LA Fitness couldn’t even do that. About an hour after Call 12 News for Action contacted LA Fitness, they offered Kristyna and Brian a refund for their unused services.</p>

				<content:encoded><![CDATA[<p>In 2005, a sophomore at Hunters Lane High School in Nashville, Tennessee rode the bus home from school and was assaulted by two other students, leaving him with serious physical injuries. <a href="http://tn.findacase.com/research/wfrmDocViewer.aspx/xq/fac.20090127_0000114.TN.htm/qx" target="_blank">The victim, Brandon Wilson, and his parents sued for damages</a>.</p>
<p>On the day of the incident, two students, Timothy McKnight and Justin Dunnigan moved from their seats near the front of the bus to harass Wilson who was sitting near the back of the bus. There had been no known previous hostility between the three students and the harassment was said to have been prompted by Wilson yelling “Fire, Fire!” in response to a passing fire truck. Once McKnight and Dunnigan moved to the back, video footage shows them verbally harassing Wilson for 3-4 minutes before returning to their seats. Less than a minute later, Dunnigan returned to Wilson’s seat and assaulted him by hitting him 3 times and causing severe physical damage.</p>
<p>The Wilsons charged that the bus driver, Tom Maddox, should have realized that Brandon was in danger and taken appropriate preventative measures to avoid the attack. The video footage shows that Maddox failed to asked McKnight and Dunnigan to return to their seats even though students are not allowed to stand while the bus is moving. In addition, he admitted to seeing McKnight and Dunnigan taunting Wilson, pointing their fingers in his face, when they went to his seat the first time. He also admitted that he should have appreciated the fact that Wilson was in danger seeing as McKnight and Dunnigan were much larger than the victim.</p>
<p>The court ruled that the attack was foreseeable; there was “an immediate threat and an interval where preventative measures could have been taken” before the attack occurred. The video and testimonial evidence proved that a “reasonable person should have known that Wilson was in danger prior to the attack.”</p>
<p>School officials have the duty to prevent an incident like this from occurring if a student seems to be in probable danger and there is time and opportunity to prevent an attack. Failure to do so is considered <a href="http://www.jacksonwhitelaw.com/az-personal-injury/types-of-injury/school-negligence/">negligence</a>. <p>In Denver in 2010, a <a href="http://www.9news.com/news/story.aspx?storyid=147467&amp;catid=339" target="_blank">19-year-old teacher’s aide was accused of sexually assaulting up to four young children </a>at a children’s center, including a girl who claimed that he “tickled” her during naptime. Similarly, in Michigan, a <a href="http://www.wjla.com/articles/2011/07/child-care-worker-accused-of-sexual-assaulting-child-4-63271.html" target="_blank">19-year-old day care employee was accused of sexually molesting a five-year-old girl</a>, again, during naptime.</p>
<p>Disturbing cases like these prompt so many questions. Why was such a pedophile left alone with young, sleeping, defenseless children? Why were they hired to work with children in the first place? Who’s to blame? Day care facilities are required to provide adequate supervision for your children, and that includes keeping them safe from all dangers.  These cases are examples of negligent supervision—children were left in the care of a company hired to keep them safe and the company breached their duty.   In both cases, the accused were permitted complete supervision of the children by the child care facility. It is paramount to point out that it is illegal in Colorado, where the 19-year-old teacher’s aide was accused of assaulting three children, for an aide to be left alone with students.  A violation of the law is negligence per se.</p>

<p>Apparently, children were left unsupervised regularly in the “in the playroom while the provider” would sit on the couch in another room. The particular incident, which involved three children, was witnessed by the daycare provider when she walked into the playroom to find the children with their pants down acting inappropriately. After questioning her child, the mother discovered that the three children involved were frequently sent to the basement to watch movies while the younger children had naptime.</p>
<p>Similarly, in Florida in April 2009, a couple claimed that their four-year-old daughter was molested by another little boy.
