Qualified retirement plans and other plans designed to defer employee compensation or to provide health and welfare benefits are governed by the Employee Retirement Income Security Act of 1974, as amended (“ERISA”). ERISA contains complex rules related to the reporting and disclosure requirements that employers must satisfy with respect to plans they maintain. Employers also must provide summary plan descriptions and other documents to employees who participate in the plans.
