Two of the ironic questions that I encounter quite regularly during a free bankruptcy consult are: 1) “I haven’t paid my bills in years, will that cause a problem if I now file bankruptcy?” or 2) “I am current on all of my bills, will that cause a problem in my bankruptcy?” The answer to both questions is, “No.”
It is quite common for people to come into my office who are current on their bills, but still struggling to make ends meet. These are individuals who typically are trying to be proactive in considering their options and trying to look towards the future. On the flip side of things, it is also very common for people to come in who have not made payments on their bills for many months. These are the people who were either too scared to speak with an attorney, or tried to exhaust every other avenue before considering bankruptcy.
The complete contradiction of these two positions goes to show that the number one thing people lack when facing financial hardship and a possible bankruptcy is good information. People don’t just need any information they find on the internet, they need credible legal advice as to their rights and options.
