Amending the Bylaws

QUESTION:  Does the Condominium Act require a board of directors to obtain membership approval to amend the bylaws?  Our board amended the bylaws to allow only resident homeowners to serve on the board.

CC&Rs and Conflicting Provisions

QUESTION: Our condominium association is rather old.  I think we were built in the early 1980s.  Our CC&Rs (Covenants, Conditions and Restrictions) are just as old so naturally some of the provisions conflict with the new statutes.  But, I understand that the statute does not apply to conflicting provision in our CC&Rs because older condominiums are grandfathered under the old laws.  Is this true?

QUESTION: My HOA has many homes that are now bank-owned.  Are those banks responsible for the prior HOA fines and unpaid assessments owed on the property from the prior owner?

Can HOAs Record Liens on Property for Fines?

QUESTION:  My HOA recorded a lien on my property for $650.  The $650 is from a $50/day fine I received for parking my car on our road while I was out-of-town.  I thought that HOAs cannot record liens on property for fines anymore.
