Rumors of Terminated CCRs

QUESTION:  At one of our meetings a concern was raised that our CCRs were terminated.  Some of our homeowners think that the foreclosures and bankruptcies in our community terminated the CCRs.  Is that true?

Can the Board Pick and Choose?

QUESTION: I appreciate your June 20th and July 4th columns about how an association can budget and collect assessments with no out-of-pocket costs. Your comments really do help. My question is whether the board can pick and choose who it will go after for unpaid assessments.

HOA’s Surviving the Recession

QUESTION:  I read your June 20th article about collecting assessments with no out-of pocket costs to the HOA with great interest.  While I agree with everything you said, I still think that in this time of short sales and foreclosures HOAs may still not see their money in some situations.  Here is the solution that our board incorporated into our HOA:  we use only 90% of our potential revenue for our budget.  So far we have been able to meet all of our obligations even through this recession.  If our attorney is successful in collecting the monies due or if we have excess at the end of the year, we put it in the reserve account.  A couple of years ago we added $12,000.00 to that reserve. Our management company has seen this work so well that they instituted it in all of their associations.  While our method may not help some of the HOAs with 40-50% or more foreclosures, it should help the majority of the homeowners associations.
